In this Wellness Talk, Lyndsey Siara, General Counsel for the Sixth Judicial Circuit, and Andrea Holder, an attorney with Dax Nelson, P.A., walk judges through the practical side of dealing with serial filers under the overhauled Florida Vexatious Litigant Law. They break down what the 2025 amendments to s. 68.093, F.S. (effective July 1, 2025) actually changed: the numerical test now counts five or more actions, finally and adversely determined, over the last seven years instead of the prior five-year window, and a pro se litigant can be designated on conduct alone; repeatedly relitigating an already-decided case, re-filing previously ruled-on papers, unmeritorious filings and frivolous delay tactics, or a prior vexatious-litigant finding from another state or federal court.
